ATU57353900.<\/p>\n<h4>1.2 Identity of the purchaser<\/h4>\n<p>&#8216;Purchaser&#8217; refers to any person who buys Austro Diesel products in the Web Store, provided they are end-consumers within the meaning of the Konsumentenschutzgesetz (KSchG) [Consumer Protection Act] and reside in Austria. Therefore:<\/p>\n<ul>\n<li>By accepting these General Terms and Conditions for the Web Store, the Purchaser represents and warrants that the purchase of Austro Diesel products in the Web Store is not related to any business activity and is intended for private use only.<\/li>\n<li>The Purchaser assures that the products purchased through the Web Store will not be resold or distributed in any other manner. Failure to comply with this provision may result in civil liability.<\/li>\n<\/ul>\n<h4>1.3 General Terms and Conditions for the Web Store<\/h4>\n<p>These General Terms and Conditions for the Web Store are intended to govern the conditions and procedures for online sales of Austro Diesel products through the Web Store. The Purchaser can print or save these GTC.<\/p>\n<p>By ticking the box next to the text \u2018I have read and agree with the General Terms and Conditions\u2019, the Purchaser acknowledges that he\/she has read and accepts the GTC.<\/p>\n<p>Austro Diesel reserves the right to amend these General Terms and Conditions for the Web Store at any time without notice, with effect for future purchases. In this case, the terms and conditions applicable to a particular purchase are always the ones the Purchaser has agreed to when placing his\/her order.<\/p>\n<h4>1.4 Product information<\/h4>\n<p>Prior to placing an order, the Purchaser can become familiar with the key characteristics and prices of the products he\/she wishes to order by reading the description next to each product.<\/p>\n<p>Austro Diesel reserves the right to add new products, remove products and change product packaging or prices at any time. Ordering procedure<\/h3>\n<h4>2.1 Placing an order in the Web Store<\/h4>\n<ul>\n<li>The Purchaser selects the product(s) of his\/her choice and adds it\/them to the \u2018Shopping Cart&#8217;. The Purchaser can check the details of the planned purchase and change them at any time.<\/li>\n<li>The Purchaser must then confirm his\/her details, billing and shipping address and the selected payment method.<\/li>\n<li>Once the purchaser has confirmed his\/her order by clicking on the \u2018Complete purchase now&#8217; button, the Purchaser is considered to have irrevocably confirmed the contents and conditions of the order, as well as the prices, characteristics, quality, quantities and delivery deadlines for the products ordered. The order is then binding for the Purchaser. The Purchaser&#8217;s order is an offer to Austro Diesel, which then accepts it by sending a confirmation (see 2.2).<\/li>\n<\/ul>\n<h4>2.2 Order confirmation<\/h4>\n<p>After an order is placed, Austro Diesel will send the Purchaser a confirmation e-mail summarising the complete contents of the order, including the terms and conditions for the order. By sending the confirmation, Austro Diesel accepts the order and a purchase contract then goes into effect. The customer will then be notified as soon as the products have been shipped.<\/p>\n<h4>2.3 Order cancellation<\/h4>\n<p>Austro Diesel reserves the right, where there is good cause, to cancel orders, in particular:<\/p>\n<ul>\n<li>if the order has been placed by a person engaged in entrepreneurial activities, if the order is unusual in nature (e.g. more than 4 products with the same reference number) or if the order is repeated at an unusually high level of frequency;<\/li>\n<li>if the Purchaser has provided incomplete or inaccurate information;<\/li>\n<li>if the Purchaser is in default with his\/her payment of the total or partial amount.<\/li>\n<\/ul>\n<p>The Purchaser may cancel his\/her order by exercising his\/her right of withdrawal under the conditions stipulated in Section 7 (Right of cancellation).<\/p>\n<h3>3. Prices<\/h3>\n<p>The prices of Austro Diesel products are quoted gross in euros, with 20% VAT included. <strong><u>Prices do not include delivery charges, which must be borne by the Purchaser.<\/u><\/strong><\/p>\n<p><strong>3.1<\/strong> &nbsp;&nbsp;&nbsp;&nbsp; Payment for Austro Diesel products can only be made using Visa or Mastercard or cash on delivery. Austro Diesel will not charge the Purchaser\u2019s credit card until the order is confirmed and the purchase contract goes into effect. Austro Diesel reserves the right to refuse to accept certain forms of payment in certain situations if the amount of the order exceeds a certain level or if the Purchaser\u2019s creditworthiness should justify such a refusal. The individual steps and payment options are described during the ordering procedure. Credit card payments are processed directly in the Web Store \u2013 i.e. customers are not redirected to an external website or platform.<\/p>\n<p><strong>3.2<\/strong> &nbsp;&nbsp;&nbsp;&nbsp; &nbsp;When paying by credit card, the Purchaser must provide the number of his\/her credit card, its VALID THRU date and the security code (three-digit number on the back of the card).<\/p>\n<p><strong>3.3<\/strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The entire transaction is executed with SSL encryption.<\/p>\n<h3>4. Shipping and delivery<\/h3>\n<h4>4.1 Delivery procedure<\/h4>\n<p>Deliveries will only be made to\/in Austria, the Czech Republic, Slovakia, Hungary, Slovenia, Serbia, Croatia, North Macedonia, Montenegro, Kosovo and Romania. For deliveries to EU Member States other than those mentioned above, please contact us via e-mail.<\/p>\n<h4>4.2 Delivery times<\/h4>\n<p>The delivery time for Austro Diesel products will depend on the shipping option selected by the Purchaser when placing the order.<\/p>\n<p>In any event, delivery shall be made within thirty (30) days of the order confirmation, unless shipment is affected by events beyond Austro Diesel&#8217;s control (force majeure) or strikes at shipping companies or the postal service.<\/p>\n<p>If items are returned to Austro Diesel because the Purchaser has not accepted the delivery of the products, the amount of the order will be refunded to the Purchaser, minus shipping costs.<\/p>\n<h4>4.3 Assumption of delivery risks<\/h4>\n<p>When deliveries are shipped, the risk of loss of or damage to goods shall not be transferred to the consumer (Purchaser) until the goods are delivered to the Purchaser or to a third party other than the carrier (and chosen by the Purchaser). If, however, the Purchaser has concluded a contract of carriage for the delivery rather than utilising a delivery option proposed by Austro Diesel, the risk of loss of or damage to goods shall be transferred to the Purchaser as soon as the goods are handed over to the carrier selected by the Purchaser.<\/p>\n<h4>4.4 Inspection of the order upon receipt<\/h4>\n<p>Notwithstanding the statutory warranty, the Purchaser is advised to check the condition of packaging immediately upon delivery and to notify the deliverer (carrier) of any concerns. It is also recommended that the Purchaser check to ensure that the delivery corresponds to the order and then notify Austro Diesel Customer Service as soon as possible if any discrepancies or defective products are discovered.<\/p>\n<h3>5. Retention of title<\/h3>\n<p>All products shall remain the property of Austro Diesel until the order has been paid in full.<\/p>\n<h3>6. Right of cancellation<\/h3>\n<h4>6.1 Information on exercising the right of cancellation of a purchase contract covering the delivery of one or more items in a single shipment<\/h4>\n<p>You have the right to cancel a purchase contract within 14 days without having to provide any reason. The cancellation deadline is 14 days after the day you or a third party other than the carrier that has been chosen by you take possession of the goods.<\/p>\n<p>In order to exercise your right of cancellation, you must notify us (Austro Diesel GmbH, Business Concorde Park 3\/2, 2320 Schwechat, Austria; tel.:&nbsp;<a href=\"tel:+43170120338\">+43 1 70 120&nbsp;338<\/a>, e-mail: <a href=\"mailto:fan-shop@austrodiesel.at\">fan-shop@austrodiesel.at<\/a>) by sending us an explicit statement of your decision to cancel the purchase contract (e.g. in a letter sent by regular mail or e-mail). You may, but are not required to, use the sample cancellation form you received for this.<\/p>\n<p>In order to meet the cancellation deadline, your notification that you are exercising your cancellation right only needs to be sent out before the deadline expires.<\/p>\n<h5><strong>6.1.1 Effects of cancellation<\/strong><\/h5>\n<p>If you cancel a purchase contract, we shall be obligated to immediately, or at the latest 14 days after the day we receive your notice of cancellation, reimburse you for all payments we have received from you, including delivery costs (except for additional costs in the event you selected a different delivery option than the least expensive standard option that we offered you). We shall reimburse you using the same payment method that you utilised for the original transaction, unless another form of reimbursement was expressly agreed upon with you; in any case, no fees will be charged to you for such reimbursement.<\/p>\n<p>We may withhold reimbursement until we have received the goods again or until you present proof that you have shipped the goods back to us (whichever occurs first).<\/p>\n<p>If you cancel the purchase contract, you must return \/ hand over to us the associated products no later than 14 days after the day you notify us of your intention to cancel the contract. The products should be returned in their original packaging and in good condition, to the extent that this is possible. Please make sure to include the cancellation form in your return shipment.<\/p>\n<p>The deadline is considered to have been met if you send the goods before the 14-day cancellation period has expired.<\/p>\n<p>You are responsible for the direct costs associated with returning the goods.<\/p>\n<p>You shall only be required to pay for any loss of value of goods if such loss was caused by any handling or use of the goods that was not necessary for evaluating the condition, characteristics and proper functioning of the goods. Returned products that have not been accepted by Austro Diesel will be returned to the Purchaser with the shipping costs paid by the same, and the return itself will not be accepted.<\/p>\n<h4>6.2 Information on exercising the right of cancellation of a purchase contract covering the delivery of multiple items in partial shipments that are part of a single order<\/h4>\n<p>You have the right to cancel a purchase contract within 14 days without having to provide any reason. The cancellation deadline is 14 days after the day you or a third party other than the carrier that has been chosen by you take possession of the last item of the delivery.<\/p>\n<p>In order to exercise your right of cancellation, you must notify us (Austro Diesel GmbH, Business Concorde Park 3\/2, 2320 Schwechat, Austria; tel.:&nbsp;<a href=\"tel:+43170120338\">+43 1 70 120&nbsp;338<\/a>, e-mail: <a href=\"mailto:fan-shop@austrodiesel.at\">fan-shop@austrodiesel.at<\/a>) by sending us an explicit statement of your decision to cancel the purchase contract (e.g. in a letter sent by regular mail or e-mail). Statutory warranty<\/h3>\n<p><strong>7.1<\/strong> &nbsp;&nbsp;&nbsp;&nbsp; The warranty is granted in accordance with statutory regulations. The Purchaser enjoys the following statutory warranty benefit:<\/p>\n<ul>\n<li>The statutory warranty for defects according to Art. 922 ff. ABGB (General Civil Code of Austria), which stipulates that the Purchaser must claim product defects within 24 months after delivery.<\/li>\n<\/ul>\n<p><strong>7.2<\/strong> &nbsp;&nbsp;&nbsp;&nbsp; In order to exercise this right, the Purchaser should contact Customer Service.<\/p>\n<p><strong>7.3<\/strong> &nbsp;&nbsp;&nbsp;&nbsp; If replacement or repair is not possible (due to excessively high costs, unreasonable circumstances, delayed claim), the Purchaser shall be entitled to a price reduction or, if the defect in question is not a minor defect, termination of the contract (cancellation). Indemnity claims for damage and consequential damages, as well as other material\/property damage, financial losses and claims from third parties against the customer, shall be excluded, unless the transaction in question is a consumer transaction.<\/p>\n<h3>8. Limitation of liability<\/h3>\n<p><strong>8.1<\/strong> &nbsp;&nbsp;&nbsp;&nbsp; Pursuant to Art. 6 para 1 (9) of the Konsumentenschutzgesetz (KSchG) [Consumer Protection Act], Austro Diesel is not liable for slight negligence if losses or damages arise due to the fraudulent manipulation of a third party and have led to a change in the information available at the Web Store, as well as in the event of force majeure.<\/p>\n<p><strong>8.2<\/strong> &nbsp;&nbsp;&nbsp;&nbsp; If, however, Austro Diesel is held liable for any damage suffered by the Purchaser as a result of Austro Diesel&#8217;s failure to perform its services, or perform its services properly, the liability shall be limited to the amount the Purchaser has paid to Austro Diesel for the order in question, if Austro Diesel can only be accused of slight negligence.<\/p>\n<p><strong>8.3<\/strong> &nbsp;&nbsp;&nbsp;&nbsp; The liability of Austro Diesel under the Produkthaftungsgesetz (PHG) [Federal Product Liability Act] shall remain unaffected by this limitation of liability.<\/p>\n<h3>9. Miscellaneous<\/h3>\n<p><strong>9.1<\/strong> &nbsp;&nbsp;&nbsp;&nbsp; The fact that Austro Diesel might not enforce one or more provisions of these General Terms and Conditions for the Web Store against the Purchaser does not in any way mean that Austro Diesel has given up its right to apply the provision(s).<\/p>\n<p><strong>9.2<\/strong> &nbsp;&nbsp;&nbsp;&nbsp; Should a provision of these General Terms and Conditions for the Web Store become ineffective, either in whole or in part, the remaining provisions and rights and obligations arising from these General Terms and Conditions for the Web Store shall remain unchanged and applicable.<\/p>\n<p><b>9.3 <\/b>&nbsp; &nbsp;&nbsp; We are obliged to participate in the arbitration procedure of the Internet Ombudsman&#8217;s Office in the event of disputes: <a href=\"http:\/\/www.ombudsstelle.at\">www.ombudsstelle.at<\/a>. Personal data<\/h3>\n<p><strong>10.1<\/strong> &nbsp;&nbsp; Personal information that you provide will be processed by Austro Diesel to manage customer accounts, send e-mails and manage, record and monitor orders, including deliveries and invoices. Personal data (details about the data used can be accessed at the following link: <a href=\"https:\/\/www.austrodiesel.at\/metanavigation\/datenschutzerklaerung\/\">https:\/\/www.austrodiesel.at\/metanavigation\/datenschutzerklaerung\/<\/a>) can be used by Austro Diesel in order to fulfil its contracts.<\/p>\n<p>Information regarding your rights under the Data Protection Act can also be found in the Privacy Policy <a href=\"https:\/\/www.austrodiesel.at\/metanavigation\/datenschutzerklaerung\/\">https:\/\/www.austrodiesel.at\/metanavigation\/datenschutzerklaerung\/<\/a>.<\/p>\n<p><strong>10.2<\/strong> &nbsp;&nbsp; After an order is placed, Austro Diesel will send the Purchaser a confirmation e-mail summarising the complete contents of the order, including the terms and conditions for the order. By sending the confirmation, Austro Diesel accepts the order and a purchase contract then goes into effect.<\/p>\n<h3>11. Intellectual property and industrial property rights<\/h3>\n<p><strong>11.1 &nbsp;<\/strong>&nbsp; The Web Store and all products are the exclusive property of Austro Diesel. No part of the Web Store may be distributed, modified, transferred or reproduced in any way whatsoever. Hyperlinks may only be embedded in the Web Store or parts of it after prior written consent has been issued by Austro Diesel.<\/p>\n<h3>12. Language \u2013 Place of jurisdiction \u2013 Applicable law<\/h3>\n<p><strong>12.1<\/strong> &nbsp;&nbsp; The language for contracts, orders and business communication is German.<\/p>\n<p><strong>12.2.<\/strong> The contractual partners agree to the application of Austrian law. The place of jurisdiction is Wien-Innere Stadt (1st municipal district of Vienna). Sie gelten insbesondere als Bestandteil des umseitigen Kaufantrages. Allgemeine Gesch\u00e4ftsbedingungen oder \u00c4hnliches des Kunden werden nicht Gesch\u00e4ftsinhalt.<br \/>Eine rechtliche Bindung von Austro Diesel tritt erst durch ausdr\u00fcckliche Annahme der Bestellung oder eines sonstigen Auftrages ein. S\u00e4mtliche Anbote von Austro Diesel sind freibleibend.<br \/>F\u00fcr den Fall, dass in den Verm\u00f6gensverh\u00e4ltnissen des Kunden eine \u00c4nderung eintritt, die abstrakt oder konkret geeignet erscheint, die Befriedigung unserer Anspr\u00fcche zu gef\u00e4hrden oder zu erschweren, insbesondere dann, wenn die Er\u00f6ffnung eines Insolvenzverfahrens \u00fcber das Verm\u00f6gen des Kunden unmittelbar bevorsteht bzw. wenn ein solches er\u00f6ffnet worden ist oder wenn ein solches mangels Masse nicht er\u00f6ffnet wird, sind wir berechtigt, f\u00fcr allf\u00e4llige Lieferungen Sicherheitsleistungen oder Vorauszahlungen zu verlangen. Au\u00dferdem sind wir berechtigt, Lieferungen nur mehr gegen Bezahlung der zugrundeliegenden Forderungen Zug um Zug durchzuf\u00fchren und bleiben dar\u00fcber hinaus gehende Anspr\u00fcche unsererseits davon unber\u00fchrt.<\/p>\n<p>II. Preise<br \/>Die Preise sind Nettopreise ab inl\u00e4ndischem Auslieferungslager ohne Verpackung und Versandkosten. Preiserh\u00f6hungen wegen \u00c4nderung unserer Einstandspreise, der Z\u00f6lle, von Frachtkosten oder von sonstiger Unkosten, wie beispielsweise aufgrund von Erh\u00f6hung oder Neueinf\u00fchrung von Abgaben bzw. aufgrund von Wertsicherungsklauseln, zwischen Bestellung und Lieferung gehen zu Lasten des Kunden und berechtigen Austro Diesel, die Preise entsprechend anzupassen.<\/p>\n<p>III. Zahlungsbedingungen<br \/>Soweit nicht anders vereinbart, sind s\u00e4mtliche Rechnungen binnen 14 Tagen ohne jeden Abzug zur Zahlung f\u00e4llig. Alle Zahlungen haben bar, spesenfrei und ohne Abzug geleistet zu werden. Schecks und Wechsel werden im Einzelfall nur nach besonderer Vereinbarung und nur zahlungshalber, nicht an Erf\u00fcllungs statt, angenommen. Einziehungs- und Diskontspesen gehen zu Lasten des Kunden.<br \/>Bei \u00dcberschreitung des Zahlungstermins und bei Annahmeverzug ist Austro Diesel unbeschadet weiterer Anspr\u00fcche berechtigt, Verzugszinsen in H\u00f6he von 8 %-Punkten \u00fcber dem jeweiligen Basiszinssatz, mindestens jedoch 12 %, zu berechnen. \u00dcberdies ist der Kunde in diesem Fall verpflichtet, s\u00e4mtliche gerichtlichen und au\u00dfergerichtlichen Kosten sowie Mahnspesen und die Kosten eines allenfalls von Austro Diesel beigezogenen Rechtsanwaltes oder eines Inkassob\u00fcros zu bezahlen. Bei Vertragsstornierung durch den Kunden ist Austro Diesel berechtigt, entweder den erlittenen Schaden und entgangenen Gewinn oder eine 15 %-ige Stornogeb\u00fchr zu fordern. Weiters hat der Kunde Austro Diesel \u00fcber Aufforderung den\/die Kaufgegenst\u00e4nde unverz\u00fcglich auf eigene Kosten zur\u00fcckzustellen.<br \/>Bei Zahlungsverzug oder Ab-\/Annahmeverzug des Kunden trotz einer 8-t\u00e4gigen Nachfrist ist Austro Diesel unbeschadet sonstiger Rechte berechtigt, die in ihrem Eigentum stehenden Waren, ohne dass dies einem R\u00fccktritt vom Vertrag gleichzusetzen ist, zur\u00fcckzunehmen oder vom Vertrag zur G\u00e4nze oder zum Teil unter Wahrung ihrer Rechte, insbesondere Schadenersatz wegen Nichterf\u00fcllung, zur\u00fcckzutreten.<br \/>Die Zur\u00fcckhaltung von Zahlungen wegen allf\u00e4lligen Gew\u00e4hrleistungsanspr\u00fcchen oder sonstigen potenziellen Anspr\u00fcchen des Kunden ist ausgeschlossen, sofern Anspr\u00fcche des Kunden (des Bestellers) nicht ausdr\u00fccklich von uns als zu Recht bestehend anerkannt worden sind.<\/p>\n<p>IV. Eigentumsvorbehalt<br \/>Der Kaufgegenst\u00e4nd bleibt bis zur vollst\u00e4ndigen Bezahlung der Forderung von Austro Diesel gegen\u00fcber dem Kunden, sohin auch jener aus anderen Lieferungen, einschlie\u00dflich Kosten, Zinsen und Verzugszinsen, Eigentum von Austro Diesel. Der Kunde erkl\u00e4rt sich damit einverstanden, dass geleistete Zahlungen zuerst auf allf\u00e4llige Reparaturkosten, dann auf Ersatzteilforderungen, in weiterer Folge auf Zinsen und sonstige Nebengeb\u00fchren und erst dann auf den unter Eigentumsvorbehalt stehenden Kaufgegenstand, sohin das Kapital, angerechnet werden.<br \/>Der Eigentumsvorbehalt kann im Typenschein (Einzelgenehmigungsbescheid) und am Kaufgegenstand vermerkt werden. Austro Diesel ist berechtigt, den Typenschein (Einzelgenehmigungsbescheid) bis zur vollst\u00e4ndigen Abdeckung s\u00e4mtlicher aus dem Kaufvertrag resultierender Verpflichtungen des Kunden einzubehalten.<br \/>Sofern von dritter Seite auf die unter Eigentumsvorbehalt gelieferten Kaufgegenst\u00e4nde gegriffen wird, hat der Kunde Austro Diesel davon unverz\u00fcglich mittels eingeschriebenen Briefes zu verst\u00e4ndigen. Allf\u00e4llige Kosten, die mit der Durchsetzung der Rechte von Austro Diesel gegen\u00fcber Dritten verbunden sind, hat der Kunde zu ersetzen.<br \/>Im Fall der Weiterver\u00e4u\u00dferung des Kaufgegenstandes tritt der Kunde dessen s\u00e4mtliche Anspr\u00fcche samt allen Nebenrechten und Sicherheiten, die ihm gegen\u00fcber seinem Abnehmer aus der Weiterver\u00e4u\u00dferung des Kaufgegenstandes zustehen, bis zur Erf\u00fcllung s\u00e4mtlicher Anspr\u00fcche von Austro Diesel gegen ihn selbst ab.<br \/>W\u00e4hrend der Dauer des Eigentumsvorbehaltes ist der Kaufgegenstand auf Verlangen von Austro Diesel vom Kunden auf den vollen Wert gegen alle Risken zu versichern und die Versicherungspolizzen sind zu Gunsten von Austro Diesel zu vinkulieren. Weiterverkauf, Verpf\u00e4ndung und Sicherungs\u00fcbereignung sind, soweit nicht ausdr\u00fccklich und schriftlich vereinbart, untersagt.<br \/>Der Kunde hat die Pflicht, w\u00e4hrend der Dauer des Eigentumsvorbehaltes die Kaufgegenst\u00e4nde in ordnungsgem\u00e4\u00dfem Zustand zu halten und erforderlich werdende Reparaturen sofort \u2013 abgesehen von Notf\u00e4llen \u2013 in den Reparaturwerkst\u00e4tten von Austro Diesel oder in einer von Austro Diesel anerkannten Werkst\u00e4tte ausf\u00fchren zu lassen.<br \/>Bei Zahlungsverzug sowie bei Verletzung einer sonstigen Vertragsbestimmung tritt Terminverlust ein.<br \/>Austro Diesel ist berechtigt, bei Zahlungsverzug des Kunden den\/die unter Eigentumsvorbehalt stehende\/n Kaufgegenst\u00e4nde auch ohne R\u00fccktritt vom Vertrag einzuziehen. Der Eigentumsvorbehalt kann \u2013 mit oder ohne R\u00fccktritt vom Vertrag \u2013 \u00fcber die gesamte Lieferung oder an einzelnen Waren geltend gemacht werden.<\/p>\n<p>V. Lieferung<br \/>Die Lieferfristen sind freibleibend, sofern sie nicht ausdr\u00fccklich als fix vereinbart werden, und stellen nur einen ungef\u00e4hren Lieferzeitraum dar.<br \/>Die Nichteinhaltung von gegen\u00fcber Austro Diesel zugesagten Lieferfristen der Lieferwerke\/der Zulieferer &#8211; aus welchem Grund immer &#8211; entbinden Austro Diesel ihrerseits von der Einhaltung vereinbarter Lieferzeiten. Schadenersatzanspr\u00fcche f\u00fcr versp\u00e4tete Lieferungen oder wegen Nichterf\u00fcllung sind in den F\u00e4llen leichter und grober Fahrl\u00e4ssigkeit jedenfalls ausgeschlossen. Allf\u00e4llige Anspr\u00fcche des Kunden an Austro Diesel k\u00f6nnen in diesem Fall nur insoweit geltend gemacht werden, als solche Anspr\u00fcche vom Lieferwerk\/dem Zulieferer gegen\u00fcber Austro Diesel anerkannt werden. Alle von Austro Diesel nicht beeinflussbaren Umst\u00e4nde gelten als F\u00e4lle von h\u00f6herer Gewalt. Dazugeh\u00f6ren insbesondere Betriebsst\u00f6rungen, Beschr\u00e4nkungen oder Verz\u00f6gerungen bez\u00fcglich der Lieferung bei Austro Diesel und deren Zulieferern. Solche Umst\u00e4nde berechtigen Austro Diesel, die Lieferung zu einem sp\u00e4teren Zeitpunkt vorzunehmen oder diese einzustellen, ohne dass der Kunde daraus Anspr\u00fcche gegen Austro Diesel geltend machen kann<br \/>Die Lieferfrist beginnt mit dem Inkrafttreten des Vertrages, jedoch niemals vor Leistung der vereinbarten Anzahlung oder der ersten Rate.<br \/>Im Fall einer vereinbarten Ab\u00e4nderung des Auftrages ist Austro Diesel berechtigt, den Liefertermin neu festzulegen.<br \/>Austro Diesel beh\u00e4lt sich Konstruktions- und Form\u00e4nderungen w\u00e4hrend der Lieferzeit vor.<br \/>Die Angaben in den Beschreibungen \u00fcber Leistungen, Gewichte, Betriebskosten, Geschwindigkeiten usw. sind f\u00fcr Austro Diesel unverbindlich. Austro Diesel haftet auch nicht f\u00fcr die Richtigkeit solcher Angaben.<br \/>Bei Reparaturen anfallendes Altmaterial geht, wenn nicht anders vereinbart, in das Eigentum von Austro Diesel \u00fcber, ohne dass es einer gesonderten Verst\u00e4ndigung oder Entsch\u00e4digung des Kunden bedarf. Die Kosten einer allf\u00e4lligen Entsorgung hat der Kunde jedoch jedenfalls selbst zu tragen.<br \/>Ein Schadenersatzanspruch des Kunden wegen Nichterf\u00fcllung oder wegen Verzug ist ausgeschlossen.<\/p>\n<p>VI. Erf\u00fcllungs- und \u00dcbernahmebedingungen<br \/>Austro Diesel hat das Recht, innerhalb von 14 Tagen nach Annahme der Bestellung vom Vertrag zur\u00fcckzutreten. Die Lieferung gilt als erf\u00fcllt:<br \/>F\u00fcr Lieferungen ab inl\u00e4ndischem Auslieferungslager:<br \/>bei Abgabe der Meldung der Versandbereitschaft. Der Kunde hat den Kaufgegenstand sofort nach Erhalt der Be- reitstellungsanzeige am vereinbarten Abnahmeort zu pr\u00fcfen und zu \u00fcbernehmen.<br \/>F\u00fcr Lieferungen mit vereinbartem Zusendungsort: mit \u00dcbergabe an den ersten Transporteur.<br \/>Verzichtet der Kunde auf die Pr\u00fcfung im Auslieferungslager ausdr\u00fccklich oder stillschweigend, so gilt der Kaufgegenstand bei Verlassen des inl\u00e4ndischen Auslieferungslagers als ordnungsgem\u00e4\u00df geliefert, abgenommen und genehmigt.<br \/>Alle Gefahren gehen im Zeitpunkt der Erf\u00fcllung auf den Kunden \u00fcber. Der Kunde hat den notwendigen Versicherungsschutz selbst und auf seine Kosten zu bewerkstelligen. Durch Austro Diesel wird ein Versicherungsschutz nur besorgt, soweit dies im Einzelnen ausdr\u00fccklich vereinbart wird. Dies gilt auch f\u00fcr zur Reparatur \u00fcbergebene Kaufgegenst\u00e4nde; und zwar vom Zeitpunkt der \u00dcbernahme bis zum Zeitpunkt der Erf\u00fcllung. Austro Diesel haftet w\u00e4hrend dieser Zeit auch nicht f\u00fcr den zuf\u00e4lligen Untergang der Sache. Wird von Austro Diesel eine Abholfrist festgesetzt und diese vom Kunden \u00fcberschritten, so kann eine Einstellgeb\u00fchr berechnet werden.<br \/>Der Versand erfolgt stets unversichert auf Rechnung und Gefahr des Kunden.<\/p>\n<p>VII. Gew\u00e4hrleistung und Haftung<br \/>Soweit vom Hersteller eine Garantie f\u00fcr eine dem jeweiligen Stand der Technik entsprechende Fehlerfreiheit des Kaufgegenstandes \u00fcbernommen wird, gilt jegliche Haftung und Gew\u00e4hrleistung von Austro Diesel als ausgeschlossen. Austro Diesel erf\u00fcllt Garantieanspr\u00fcche des Kunden insoweit, als diese vom Lieferwerk anerkannt und getragen werden.<br \/>Wird vom Hersteller keine Garantie gew\u00e4hrt, so leistet Austro Diesel im Rahmen der gesetzlichen Bestimmungen Gew\u00e4hr. Die Gew\u00e4hrleistungsfrist f\u00fcr bewegliche Sachen betr\u00e4gt sechs Monate, wobei stets der Kunde nachzuweisen hat, dass der Mangel bereits bei \u00dcbergabe vorhanden war. Der Kunde hat die Ware unverz\u00fcglich nach \u00dcbergabe (Anlieferung\/Abholung) zu untersuchen und Austro Diesel einen allenfalls entdeckten Mangel ebenso unverz\u00fcglich detailliert schriftlich anzuzeigen. Unterl\u00e4sst der Kunde die ordnungsgem\u00e4\u00dfe Anzeige (sei es auch nur in der vereinbarten Form), so gilt die Ware als genehmigt, es sei denn, dass es sich um einen Mangel handelt, der bei der Untersuchung nicht erkennbar war. Zeigt sich sp\u00e4ter ein solcher Mangel, so muss die Anzeige unverz\u00fcglich nach Entdeckung gemacht werden, widrigenfalls der Kaufgegenstand auch in Ansehung dieses Mangels als genehmigt gilt.<br \/>Leistungen, die aufgrund ungerechtfertigter M\u00e4ngelr\u00fcgen erbracht werden, gelten als Auftrag und sind vom Kunden zu bezahlen.<br \/>Jeder Gew\u00e4hrleistungs- und Garantieanspruch erlischt, wenn der Kunde die Vorschriften \u00fcber die Behandlung des Kaufgegenstandes (Betriebsanleitung) nicht befolgt und insbesondere die vorgeschriebenen \u00dcberpr\u00fcfungen (Pflichtservice) nicht ordnungsgem\u00e4\u00df und zeitgerecht durchf\u00fchren l\u00e4sst. Der Kunde hat daher beides nachzuweisen. Keine Gew\u00e4hr geleistet wird jedenfalls f\u00fcr s\u00e4mtliche Sch\u00e4den, die durch ungen\u00fcgende Wartung, Bedienungsfehler sowie durch h\u00f6here Gewalt entstanden sind.<br \/>Auch im Fall berechtigter Gew\u00e4hrleistung verzichtet der Kunde rechtsverbindlich auf die Geltendmachung von Minderung oder (und) Wandlung oder (und) auf Ersatz eines mittelbaren oder (und) unmittelbaren Schadens.<br \/>Nat\u00fcrlicher Verschlei\u00df und Besch\u00e4digungen, die auf Fahrl\u00e4ssigkeit oder unsachgem\u00e4\u00dfe Behandlung zur\u00fcckzuf\u00fchren sind, sind von der Gew\u00e4hrleistung und einer allf\u00e4lligen Garantie ausgeschlossen.<br \/>Die Gew\u00e4hrleistung oder Garantie erlischt, wenn der Kaufgegenstand von fremder Seite oder durch Einbau von Teilen fremder Herkunft ver\u00e4ndert bzw. repariert worden ist. Die Gew\u00e4hrleistung oder Garantie erstreckt sich nicht auf Reifen, Schl\u00e4uche, Filter, Schmiermittel, Dichtungen, elektrische Beleuchtungsanlage(n) und sonstige Ausr\u00fcstung(en).<br \/>Das Erheben von Gew\u00e4hrleistungsanspr\u00fcchen entbindet den Kunden nicht von der vertraglich vereinbarten Zahlungspflicht. Dies gilt auch hinsichtlich Serviceleistungen und E-Teilfakturen. Jeder Gew\u00e4hrleistungsanspruch erlischt bei Zahlungsverzug des Kunden.<br \/>In F\u00e4llen, in den keine Gew\u00e4hr geleistet wird, ist auch jeglicher Schadenersatz ausgeschlossen. Im \u00dcbrigen haftet Austro Diesel \u2013 soweit zul\u00e4ssig \u2013 lediglich bei Vorsatz und grober Fahrl\u00e4ssigkeit.<br \/>Die Ersatzpflicht von Austro Diesel f\u00fcr Sachsch\u00e4den nach dem Produkthaftungsgesetz ist ausgeschlossen. Ebenso ausgeschlossen sind Produkthaftungsanspr\u00fcche, die aus anderen Bestimmungen abgeleitet werden k\u00f6nnen.<\/p>\n<p>VIII. Aufrechnungsverbot, Rechtswahl, Gerichtsstand<br \/>Eine Aufrechnung mit behaupteten Gegenforderungen des Kunden gegen offene Forderungen von Austro Diesel \u2013 welcher Art auch immer (insbesondere Kaufpreisraten, sonstige Liefer- und Leistungsforderungen, bereicherungs- rechtliche Anspr\u00fcche im Fall einer Vertragsr\u00fcckabwicklung) &#8211; ist nicht zul\u00e4ssig. Ebenso ist der Kunde nicht berechtigt, wegen behaupteter Gew\u00e4hrleistungs-, Schadenersatz- oder sonstiger Anspr\u00fcche Austro Diesel gegen\u00fcber Zahlungen zur\u00fcck zu halten.<br \/>Es gilt \u00f6sterreichisches Recht unter Ausschluss von nationalen und \u00fcbernationalen Verweisungsnormen sowie unter Ausnahme des UN-Kaufrechts.<br \/>Die Vertragssprache ist Deutsch, sofern im Einzelfall nichts anderes vereinbart wird. Erf\u00fcllungsort und ausschlie\u00dflicher Gerichtsstand ist Wien-Innere Stadt.<\/p>\n<p>IX. Datenverarbeitung, Datenschutz<br \/>Austro Diesel verarbeitet den Namen, Anschrift und sonstige die Gesch\u00e4ftsbeziehung betreffende Daten des Kunden zur Gesch\u00e4ftsabwicklung. Austro Diesel verarbeitet dar\u00fcber hinaus die personenbezogenen Kundendaten zu Marketingzwecken zur Zusendung von Informationen \u00fcber Produkte und Waren von Austro Diesel per E-Mail und Post. Der Kunde kann Austro Diesel jederzeit mittels E-Mail an privacy@austrodiesel.at mitteilen, keine Werbung mehr erhalten zu wollen.<br \/>Weitergehende Information zum Datenschutz finden Sie in der Datenschutzerkl\u00e4rung von Austro Diesel unter www.austrodiesel.at\/metanavigation\/datenschutzerklaerung\/ auf unserer Webseite, die Teil dieser Liefer- und Gesch\u00e4ftsbedingungen ist.<\/p>\n<p>X. Diverses<br \/>Soweit einzelne Vertragsbestimmungen, aus welchem Grund immer, ung\u00fcltig sein oder ung\u00fcltig werden, ber\u00fchrt dies nicht die G\u00fcltigkeit der \u00fcbrigen Bestimmungen dieser Liefer- und Gesch\u00e4ftsbedingungen. Die einzelnen Regelungen sind soweit m\u00f6glich geltungserhaltend zu reduzieren bzw. gilt eine Regelung als vereinbart, die der nicht anzuwendenden am ehesten entspricht.<\/p>\n<p>XI. \u00c4nderung der Liefer- und Gesch\u00e4ftsbedingungen<br \/>Austro Diesel beh\u00e4lt sich das Recht vor, \u00c4nderungen und Erg\u00e4nzungen an der Homepage sowie diesen Allgemeinen Gesch\u00e4ftsbedingungen jederzeit vorzunehmen. Auf Bestellungen finden jeweils die Verkaufsbedingungen, Vertragsbedingungen und Allgemeinen Gesch\u00e4ftsbedingungen Anwendung, die zu dem Zeitpunkt der Bestellung in Kraft sind, es sei denn eine \u00c4nderung an diesen Bedingungen ist gesetzlich oder auf beh\u00f6rdliche Anordnung erforderlich (in diesem Fall sie auch auf Bestellungen Anwendung finden, die zuvor get\u00e4tigt wurden).
